2. Scope of Application

These Terms and Conditions of Sale (TCS) apply to all orders placed on the website www.thermomixbenelux.de by consumers (natural persons acting outside of commercial or professional activity) residing within the European Union.

By confirming your order, you unreservedly accept these TCS.

3. Products

The products offered are kitchen household appliances, mainly Thermomix devices, which are new and compliant with applicable European legislation.

Each product is accompanied by a detailed description. The photos are as accurate as possible but non-binding.

4. Orders

Customers may place orders on the website 24/7.
An order becomes final only after email confirmation.

Thermomix Benelux reserves the right to cancel or refuse any order in the event of a dispute with the customer or full/partial non-payment of a previous order.

5. Prices and Payment Terms

Prices are shown in euros (€), including all taxes (VAT included).
Shipping is free for all orders delivered within the European Union.

Thermomix Benelux reserves the right to modify prices at any time, but products will be invoiced at the rate in effect at the time of order confirmation.

Payment is due immediately upon ordering.
Payment must be made by bank transfer, using the details provided after the order is confirmed.
Orders will be prepared and shipped only after receipt of the transfer.

6. Delivery

Products are delivered within the European Union to the address provided at the time of the order.
Delivery times are generally 3 to 7 working days (excluding pre-orders).

Delivery is free of charge to Germany, Austria, and all other European Union countries.

In case of unusual delays, you will be notified by email.

7. Right of Withdrawal

In accordance with Directive 2011/83/EU, the customer has a period of 14 calendar days from receipt of the order to exercise the right of withdrawal without justification or fees.

To do so, simply send a written request to: kontact@thermomixbenelux.de

The product must be returned:

• In its original condition
• Unused
• In the original packaging, with all accessories included

Return shipping costs are the responsibility of the customer.

The refund will be made within 10 working days after the product is received and inspected.

8. Legal Warranties

All products come with:

• The legal warranty of conformity (Articles L217-4 to L217-14 of the French Consumer Code)
• The warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code)

If a product is non-compliant or defective, please contact our customer service.

9. Liability

Thermomix Benelux cannot be held liable for:

• Improper use of the products
• Indirect damages or data loss
• Delays caused by events beyond our control (force majeure)

10. Personal Data

Your data is processed in compliance with the General Data Protection Regulation (GDPR).

11. Applicable Law – Disputes

These TCS are governed by German law, in accordance with our registered office.

In the event of a dispute, an amicable resolution will be sought first.
If unsuccessful, the competent courts will be those of Berlin, unless otherwise required by mandatory law.

12. Modification of the TCS

Thermomix Benelux reserves the right to modify these Terms and Conditions at any time.
The version applicable is the one in force at the time of the order.
